Wills and Probate

Losing someone close to you is a deeply upsetting experience. Someone also has to deal with their ‘estate’ which is the money, property and possessions the person who died had at the time of their death. ‘Probate’ is a process which involves collecting any money that is owed, settling any debts due and dividing the estate amongst the respective beneficiaries.

At PFMolony Solicitors we can assist you with a wide range of will and probate legal services including:

  • Will and codicil writing
  • Estate planning
  • Probate / estate administration
  • Lasting Power of Attorney
  • Setting up a trust
  • Advice for executors and trustees
  • Gift / inheritance tax issues
  • Extracting grants of probate and letters of administration
  • Executors duties
  • Succession disputes and entitlements
  • Wards of court applications

We can also advise you on potential legal claims, for example, the right of a spouse to a legal right share, the rights of a co-habitant or the rights of a child to an inheritance from a parent. We can also advise beneficiaries on their entitlements.

The Succession Act 1965

The law on succession in Ireland is governed by the Succession Act 1965.In order for the next-of-kin or beneficiaries to receive their inheritance the deceased’s estate needs to be ‘administered’ through the Probate Office of the High Court by a personal representative.

Once the application to the Probate Office has been finalised, a Grant of Representation will issue, which will enable the personal representative to collect in the assets of an estate and sell any house/land. At PF Molony, we can guide you through this process.
